GENERAL TERMS OF SALE

These terms and conditions apply to the online purchase/sale of products offered by MASMUSCULO through its website https://www.masmusculo.com/. The term "Customer" refers to the recipients of the products offered on the website who purchase them.

By placing an order, the Customer accepts all the terms and conditions set out in this section and declares to know and accept the legal notice information and the privacy policy.

Purchase process

To make purchases through our website, you can do so as a registered user. You can register by filling out the following form, so that in your next purchases the system will remember you and speed up your purchase process.

You can also make purchases without registering through the instant order form. Select your products and add them to the shopping cart, click the process order button to verify your purchase and proceed to payment to complete it. Once payment is verified, MASMUSCULO will proceed to manage the shipment of your order.

Prices

Prices are indicated in euros and include taxes. Shipping costs applicable in each case must be added to these amounts.

For shipments to Canary Islands, Ceuta, and Melilla, VAT is exempt; IGIC or tax and the corresponding tariffs must be paid based on the generic tariff classification.

Shipping

We work with NACEX (24h), GLS, and CORREOS EXPRESS (48/72h) for shipments to the mainland.

To guarantee 24-hour delivery (EXPRESS SHIPPING), the following conditions must be met:

1 – The product or products ordered must be available. If the product shows, for example, the notice “shipping in 4 – 7 days,” this product is not available in our warehouse, we have to order it from the manufacturer, and it will arrive within this timeframe. Therefore, in this case, there is no 24-hour delivery.

2 – The order must be completed before 4 p.m. If the order is placed after this time, even if express shipping is paid for, the order cannot be delivered the next business day.

3 – 24-hour delivery is only available for the mainland.

4 – Delivery will never be on Saturday or Sunday, always on the next business day after the order is placed.

5 – Fresh products are shipped from the manufacturer's facilities and delivered within 48/72 hours under the shipping conditions established by the manufacturer (dropshipping).

Orders to the Canary Islands and Portugal will be shipped with Nacex, to Ceuta, Melilla, and the Balearic Islands with Correos.

In Italy, we ship with Gls and in France and Germany with Mondial Relay and Seur.

Payment methods

At MASmusculo.com you can pay for your purchase in one of the following ways.

    PURCHASE CONFIRMATION - If you buy with Scalapay, you will receive your order and pay in 3 installments. You confirm that the installments will be sold to and purchased by Retail Instalments SPV 1 Limited, its related parties and beneficiaries, and hereby unconditionally and irrevocably authorize and consent to this sale.

Note: MASmusculo does not have access to card or PayPal account data; this information is stored on Servired and/or PayPal servers. The MASmusculo.com platform directs payments through the PayPal and Servired gateways as payment is made directly to these providers' servers. MASmusculo will only be informed about the payment result, NEVER about numbers, codes, or passwords.

Purchase invoice

If you want to obtain the invoice for your purchase on MASmusculo.com you can get it directly by accessing your Personal Area, in the sectionMy Orders; once your order has been delivered. You can also request the invoice in paper or electronic format. To do so, you can write to us at our email:[email protected] make the request, and we will ship as soon as possible.

Delivery times

Delivery time for mainland destinations is 24 hours after your order is fully completed. 

For the Balearic Islands, the delivery time for goods is 3/4 business days following the shipment of your order. 

Orders to Canary Islands ship on Wednesday mornings and, from that day, take 7/8 business days to reach the Canarian transport agency. Once there, they will be delivered within 24 hours to Santa Cruz and within 48 hours to Las Palmas. Please note that if a product not physically available in our Granada warehouse (shipping in 4–7 days) is added, the order preparation will be delayed by this period.

For destinations in Ceuta and Melilla, delivery time is between 7 and 12 days.

For other destinations within Europe, delivery time can be between 36 hours and 4 days. 

Payment confirmation time can take up to 48 hours for purchases made via bank transfer.

We understand these delivery times as business days, Monday to Friday, and for orders placed on ww.masmusculo.com before 3 PM.

Delivery is considered completed once the product is made available to the Customer by the carrier and the recipient signs for receipt of the delivery. It is the recipient's responsibility to verify the products upon receipt and to report any justified reservations and claims.

If the customer receives a defective product, they may proceed with its return by notifying Moremuscle of this issue by phone at 910 60 96 55 or by email [email protected]. We will then indicate how to send the product to us.

The customer must inform Moremuscle of any non-conformity within two months from when they became aware of it. In case of a defective product, the seller will proceed, as appropriate, with repair, replacement, price reduction, or contract termination, procedures that will be free of charge for the consumer and user. The seller is responsible for non-conformities that appear within two years from delivery.

Deliveries will be made with costs borne by the Customer, unless circumstances apply that imply free shipping.

Orders will not be delivered to PO boxes.

If for any reason we cannot meet the delivery date, we will inform you of this circumstance.

Please note in any case that we do not make deliveries on Saturdays or Sundays.

Withdrawal and returns

Withdrawal

The customer may withdraw from the order placed, that is, proceed with its return and refund, within 14 calendar days from receipt of the order. Moremuscle will not apply return shipping costs. The right of withdrawal does not apply to the following product categories:

  • Food with an expiration date less than 1 month, according to article 103.d of Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws.
  • Underwear, swimwear, cosmetics, and other sealed products that are not suitable for return for health or hygiene reasons and that have been unsealed after delivery, according to article 103.e of Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws.

If the product is not returned in its original packaging, the item may suffer depreciation. To exercise the right of withdrawal, the customer must notify Moremuscle in a reliable manner by postal mail to the following address c/Viznar - Parcela 3-6, Albolote 18220 - Granada or by email addressed to:[email protected].

You may use the following form, although its use is not mandatory:

To accept a return due to withdrawal, the product must be in perfect condition and retain all its accessories and original documentation.

You must return or deliver the goods directly to us at our offices at c/Viznar - Parcela 3-6, Albolote 18220 - Granada

The refund will be made as soon as possible and, in any case, within a 14 calendar day period from the date the customer notified their intention to withdraw. It will be processed through the same payment method used for the purchase, and the refund may be withheld until the goods are received or until the consumer provides proof of return, such as a transport company receipt.

Returns

Defective or damaged product and missing product:

If the customer receives a defective or damaged product, they may return it by notifying MASMUSCULO of the issue by email at[email protected] providing appropriate evidence (photos and video). We will then instruct you on how to send the product back, and, as appropriate, proceed with repair, replacement, price reduction, or product refund.

When receiving an order in poor condition, the best course of action is to accept the delivery “with reservation”, documenting the order’s condition with photographic evidence and a video that must be recorded at the time of opening the box, not afterwards.

Claims for missing products will not be accepted if an order has been delivered in poor condition and the delivery was not accepted with reservation or photographic material and a video were not provided.

Product Guarantees

In case of a defective product, the seller must proceed, as appropriate, with repair, replacement, price reduction, or contract termination, all of which will be free of charge for the consumer and user.

MASMUSCULO is responsible for non-conformities that appear within three years from delivery. The consumer and user must report the non-conformity by phone at 910 609 655 or in writing, by email to[email protected]

MASMUSCULO will provide after-sales assistance to the consumer and user, as well as after-sales service and commercial guarantees, along with their conditions.

Unless proven otherwise, it will be presumed that non-conformities manifested within two years following delivery of the good already existed when it was delivered.

Modification of these conditions

MASMUSCULO may modify these conditions, so it is recommended that the client/user read them during each purchase process or visit to the Website. Modifications will not have retroactive effects on contracts or orders already made.

Likewise, in compliance with the provisions of the Alternative Dispute Resolution Law, we inform consumers that, as an affiliated entity and under the terms of theCode of Conduct, users may turn to Confianza Online for the alternative resolution of potential disputes (https://www.confianzaonline.es/como-reclamar/formulario-de-reclamaciones/). If these relate to electronic transactions with consumers or data protection when related to this area, claims will be resolved by the Confianza Online Mediation Committee, accredited for alternative dispute resolution in consumer matters.

Jurisdiction

This Agreement shall be governed by Spanish law,which shall apply with respect to its validity, interpretation, execution, and compliance.
